What you need to know

1.0 Invoicing and Agreed Services for Hair and Makeup

1.1 By making a deposit or additional payment, you accept the Terms and Conditions and enter a contract with Gemma Hull Hair and Makeup.
1.2 We will send you an invoice outlining the agreed hair and makeup services.
1.3 The invoice cannot be modified at any time, including the due date, except under the circumstances described in Paragraph 1.4.
1.4 Exceptions to Paragraph 1.3 include:

  • Adding clients or services, subject to Gemma Hull Hair and Makeup’s agreement (due to time or resource constraints).
  • Other adjustments agreed upon with Gemma Hull Hair and Makeup during a trial session (if applicable).

1.5 Cancelled clients will be charged the full invoiced amount. Refer to Paragraphs 6.1-6.5 and 7.1-7.5 for more details.
1.6 Unsatisfied clients will still be charged the full invoiced amount after service completion..
1.7 If you don’t inform Gemma Hull Hair and Makeup about any factors that could impact an artist’s ability to deliver the invoiced services, the artist will make every effort to complete the work. The artist reserves the right to use their professional judgement to modify the services as needed, ensuring all other agreed tasks meet the highest standards within the allocated time.
1.8 Necessary changes will result in the full invoiced amount being charged.
1.9 Your statutory rights remain unaffected.

2.0 Wedding Hair and Makeup Services Overview

2.1 Wedding hair and makeup services cater to events where at least one client is a bride, no matter the ceremony’s size or type (for instance, blessings are included as wedding services).
2.2 Group bookings without a bride will be classified as Special Occasions, such as guests attending weddings who aren’t part of the bridal party.
2.3 A bridal party must consist of a minimum of three people, including the bride (required), mothers (of the bride or groom), matron of honour, maid of honour, bridesmaids, honour attendants, bride’s attendants, junior bridesmaids, and flower girls.
2.4 Fixed-price bridal packages are non-negotiable and offer discounts compared to buying services individually.
2.5 Gemma Hull Hair and Makeup may give discretionary discounts on other wedding services. These discounts may be available through promotions, loyalty codes, or other methods outlined in the Terms and Conditions, on the website, or via official channels.
2.6 Only one eligible discount can be applied to a single invoice (refer to Paragraph 2.7 below).
2.7 As bridal packages are already discounted, no further discounts can be added. Choosing a bridal package means additional discounts won’t be applicable.

3.0 Wedding Hair and Makeup Trials

3.1 All brides must attend a Wedding Hair and Makeup Trial. This helps Gemma Hull Hair and Makeup discuss your ideas and practice your desired look before the big day, ensuring client confidence and artist preparation.
3.2 Wedding Trials aren’t required for other bridal party members.
3.3 It is recommended to complete Wedding Trials 2-3 months before the wedding day.
3.4 Wedding Trials last 2-3 hours. Extra time is charged at £15.00 per 15 minutes, unless the maximum number of hairstyle changes and makeup looks hasn’t been reached (see paragraph 3.6).
3.5 Wedding Trials will last between two and three hours. Additional time will be charged at £15.00 per 15 minutes or part thereof unless the maximum number of hairstyle changes and makeup looks has not yet been reached. See paragraph 3.6.
3.6 A standard Wedding Trial package includes up to three hairstyle changes and two makeup looks.
3.7 If a client is unsure or unhappy after a trial, one more Wedding Trial can be booked at a non-refundable, discounted rate of £50.00 (travel costs still apply).
3.8 Gemma Hull Hair and Makeup reserves the right to cancel any booking if a client remains undecided after a second Wedding Trial. This is treated as a client-initiated cancellation of Wedding Services, as outlined in paragraphs 6.1-6.4.

4.0 Deposits and Final Payments

4.1 Except for Paragraph 4.3, all payments must be made through BACS, PayPal, or another online payment service. Any transaction fees from merchant services will be the client’s responsibility and added to the invoice.
4.2 Wedding Trial or Special Occasion deposit (optional). A £25.00 deposit can be made to secure your Wedding Trial or Special Occasion date. The wedding day will be allocated, but not secured.
4.3 Wedding Day deposit (mandatory). A cash payment of 50% of the total invoice is required after the Wedding Trial. Gemma Hull Hair and Makeup will collect this before leaving the trial and secure the wedding day date.
4.4 Final payment. Full payment of the invoice is required at least one month before the Wedding Day or Special Occasion. Issues arising from not following this term are the client’s responsibility.
4.5 Gemma Hull Hair and Makeup may cancel any booking not made according to the schedule in paragraphs 4.2-4.4. This could result in a client-initiated cancellation of Wedding Services (paragraphs 6.1-6.4) or other services (paragraphs 7.1-7.4).
4.6 Gemma Hull Hair and Makeup can change the date of any service not secured by a deposit or final payment to accommodate another client’s booking. If this affects an unsecured Wedding Day or the client disagrees, it will be treated as a client-initiated cancellation of Wedding Services (paragraphs 6.1-6.4) or other services (paragraphs 7.1-7.4).
4.7 If a client faces sudden financial hardship and cannot meet the payment schedule in paragraphs 4.2-4.4, they should inform Gemma Hull Hair and Makeup immediately in writing, declaring their “Special Circumstances” and a proposed payment plan. Gemma Hull Hair and Makeup will decide whether to accept the Special Circumstances and, if agreed, offer a new payment schedule. This is the only case where a late payment might be authorized, delaying formal recovery of the owed amount (see paragraphs 14.1-14.4). This may also result in a client-initiated cancellation of Wedding Services (paragraphs 6.1-6.4) or other services (paragraphs 7.1-7.4).

5.0 Travel and accommodation

5.1 No longer applies (as of 16/01/22).
5.2 The mileage rate is currently £0.50 per mile.
5.3 All travel will be calculated from the home postcode of the assigned artist to the venue(s), and include all parts of their journey. Where more than one artist is attending, only the longest journey will be charged. For Weddings, this will cover both the Wedding Trial and Wedding Day journeys, in both directions.
5.4 The same rate and mileage calculations will apply for all other Services.
5.5 Where travel to and from a venue or location is prohibitive within a normal working day, assessed as 8.00 am to 6.00 pm, hotel accommodation may be expected. This should be booked and paid for in advance by the client after discussion with Gemma Hull Hair and Makeup. The same applies to travel and accommodation for international work.
5.6 Mileage is calculated by Gemma Hull Hair and Makeup using online tools. The invoiced rate and mileage are non-negotiable.
5.7 Drivers’ hours will comply with GB domestic driving rules.

6.0 Client-initiated cancellations of Wedding Services

6.1 If a client has to cancel their booking because of unforeseen circumstances, all monies already paid will be forfeited to offset work lost on previously reserved days.
6.2 Any cancellation made within one month of a Wedding Day will still require payment of the full invoiced amount to offset work lost on previously reserved days.
6.3 Only under “Special Circumstances” will any deviation from paragraph 6.1 or 6.2 be allowed, and only in writing. What constitutes Special Circumstances is entirely at the discretion of Gemma Hull Hair and Makeup. Clients will be advised of the outcome of any appeal.
6.4 Any payments required under these Terms and Conditions of Service not made in the schedule described at paragraphs 4.2-4.4 will be recovered as described under Recovery of monies owed at paragraphs 14.1-14.4.
6.5 Any cancellation initiated directly by a client, or indirectly as a result of clients not fully complying with these Terms and Conditions of Service will be regarded as “client-initiated”.

7.0 Client-initiated cancellations of all other services

7.1 If a cancellation is made longer than one month before the date of the required Special Occasion, then only a deposit (if made to secure a specific date) will be forfeit to offset work lost on a previously reserved day.
7.2 Any cancellation made within one month of a Special Occasion will still require payment of the full invoiced amount to offset work lost on previously reserved days.
7.3 Only under “Special Circumstances” will any deviation from paragraph 7.1 or 7.2 be allowed, and only in writing. What constitutes Special Circumstances is entirely at the discretion of Gemma Hull Hair and Makeup. Clients will be advised of the outcome of any appeal.
7.4 Any payments required under these Terms and Conditions not made in the schedule described at paragraphs 4.2-4.4 will be recovered as described under Recovery of monies owed at paragraphs 14.1-14.4.
7.5 Any cancellation initiated directly by a client, or indirectly as a result of clients not fully complying with these Terms and Conditions of Service will be regarded as “client-initiated”.

8.0 Cancellation by Gemma Hull Hair and Makeup

8.1 Under these Terms and Conditions of Service, where a cancellation is initiated by Gemma Hull Hair and Makeup and the client is not responsible (as described in paragraphs 3.8, 4.5-4.7, 6.1-6.2 and 7.1-7.2) then a full refund of any deposits and final payment (if applicable) will be paid immediately.
8.2 With your permission, Gemma Hull Hair and Makeup will make every effort to find a replacement team to assist you, where time permits.

9.0 The Wedding Day

9.1 If your bridal party consists of five or more people requiring hair and makeup (i.e. 10 services), your artist will need an assistant. This will incur an additional cost.
9.2 If one artist is working on three or more people, please ensure your bridal party are very clear about the look or hairstyle they would like. They should discuss their ideas by email in advance of the booking. Also, be clear about the length and texture of the hair because this affects timings.
9.3 Where any issue not disclosed at the Wedding Trial or in subsequent correspondence appears to affect the limited time available with any one person, the artist(s) reserve the right to exercise professional judgement, amending their services as they see fit; this will ensure all other agreed work is completed to the highest possible standard, within the allotted time. Members of the bridal party must be aware that most time and focus will be spent on the bride.
9.4 Under no circumstances will the artist(s) have time to change hair or makeup once the style has been created.
9.5 Gemma Hull Hair and Makeup are hair specialists, not hairdressers. They specialise in hair updos and curls. If blow-dries are required, please be very clear when booking a blow-dry (see Paragraph 9.6).
9.6 If a member of the bridal party is especially particular about their hair and/or makeup, including how they would like a blow-dry performed, Gemma Hull Hair and Makeup suggest that the member pay an additional fee for a trial before the wedding; or if preferred, hire the services of their regular hair and/or makeup artist, or hairdresser, if this will help them.
9.7 No longer applies (as of 6/12/21).

10.0 Adverse weather conditions

10.1 If adverse weather conditions (or circumstances resulting from such weather, including flooding, landslides or such like) make it impossible or too dangerous to reach your venue, liability shall be limited to a full refund of all monies paid.
10.2 What constitutes ‘impossible’ or ‘too dangerous’ will be determined by the artist(s) assigned to you and is entirely at their discretion. This has never happened to Gemma in twenty years, however, it is best to be prepared!

11.0 Road traffic conditions

11.1 If the artist(s) assigned to you is delayed in traffic due to congestion, a road traffic collision or another incident that is out of their control, they will attempt to notify you by mobile telephone (voice or data).
11.2 On arrival, the artist reserves the right to exercise professional judgement, amending their services as they see fit; this will ensure all other agreed work is completed to the highest possible standard, within the allotted time. They will do so by omitting the lowest priority client(s) first, as determined by yourself. Liability shall then be limited to a refund for every client affected by this amendment to the agreed work.
11.3 If the artist(s) cannot attend at all, a full refund will be issued immediately. This clause however, has never been required in twenty years!

12.0 Injury, illness, or other medical issues

12.1 If a client is affected by injury, illness, or other medical issues and cannot complete their appointment as contracted, this will be regarded as a client-initiated cancellation. Paragraphs 6.1-6.5 and 7.1-7.5 refer.
12.2 If the artist(s) assigned to you are affected by injury, illness, or other medical issues and cannot complete their appointment as contracted, this will be regarded as a cancellation by Gemma Hull Hair and Makeup. Liability will be limited to a full refund of all monies paid and, with your permission, Gemma Hull Hair and Makeup will make every effort to find a replacement team to assist you, where time permits.

COVID-19

12.3 Gemma Hull Hair and Makeup will make every effort to ensure the safety of their clients and themselves. Artist(s) will adhere to published guidelines or countermeasures as directed by the UK Government and/or regional authorities at the time of their appointment(s). To maintain the highest standards of hygiene, artists will apply (as far as reasonably practicable) industry-accepted best-practice during their work. These standards may change from time-to-time.
12.4 No longer applies (as of 12/2/23).
12.5 Where mandated guidelines or countermeasures affect the delivery of services agreed in the contract, any amendment to the schedule of work will be reviewed on a case-by-case basis, with alternative arrangements made accordingly.

13.0 Intolerant or other inappropriate behaviour

13.1 If any client or other person at a client’s venue makes the assigned artist(s) feel uncomfortable, threatened or otherwise unwelcome, Gemma Hull Hair and Makeup reserve the right to stop work immediately and terminate the booking, leaving the premises without notice. Assigned artists will expect fair and dignified treatment for their professional services at all times. If a booking is terminated, it will be treated as a client-initiated cancellation as described in paragraphs 6.1-6.4 or 7.1-7.4.
13.2 Such behaviour might include, but is not limited to: bad manners, raised voices, throwing things or slamming doors. Such behaviour need not be directed at the artist. Any behaviours perceived as harassing, bullying, threatening, overtly sexual or criminal in nature may also be reported to the authorities, as appropriate.

14.0 Recovery of monies owed

14.1 If payments required under these Terms and Conditions of Service are not made in the schedule described at paragraphs 4.2-4.4, Gemma Hull Hair and Makeup reserves the right to formally recover the monies owed.
14.2 If payment is not made within 30 days of the date the service is delivered and this has not been authorised by Gemma Hull Hair and Makeup as described in paragraph 4.7, then formal recovery action will be taken.
14.3 Any unauthorised late payment may result in Gemma Hull Hair and Makeup declining future requests for work or services.
14.4 Any action to recover these payments will be stopped if payment of the sum owed plus an additional Recovery Fee has been made. The Recovery Fee will be determined by the cost of any recovery action taken at the time payment is settled.

15.0 Indemnification

15.1 You hereby indemnify to the fullest extent Gemma Hull Hair and Makeup from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms and Conditions of Service.

16.0 Severability

16.1 If any provision of these Terms and Conditions of Service is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

17.0 Variation of Terms

17.1 Gemma Hull Hair and Makeup are permitted to revise these Terms and Conditions of Service at any time as they see fit, and by using their services, you are expected to review these Terms and Conditions of Service regularly.

18.0 Assignment

18.1 The Gemma Hull Hair and Makeup are allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms and Conditions of Service without any notification.
18.2 You are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms and Conditions of Service.

19.0 Entire Agreement

19.1 These Terms and Conditions of Service constitute the entire agreement between Gemma Hull Hair and Makeup and you concerning your use of Gemma Hull Hair and Makeup services and supersede all prior agreements and understandings.

20.0 Governing Law & Jurisdiction

20.1 These Terms and Conditions of Service will be governed by and interpreted per the laws of the United Kingdom and of the E.U. (where applicable), and you submit to the non-exclusive jurisdiction of the courts located in Gloucestershire for the resolution of any disputes.
